简析原则法律解释规则与法律翻译对策主张

摘要：法律解释的历史与法律本身的历史几乎一样悠久，而作为一门古老而历久弥新的学科，法律解释在当今日新月异的新语境下，更加凸显其重要量。一方面，它强调对法律实践的反思，另一方面，它站在本体论的立场上，寻求着法律解释在法律适用中的规则运用和法律真理性的认知。除英国法律解释中三大闻名遐迩的解释规则以外，法律解释学经过进一步进展，其他几种主要法律解释规则也逐步为人所熟知。本论文将选取理解原则（Comprehension Rule）和平义原则（PlainMeaning Rule）作为浅析的切入路径，通过比较的探讨的策略，寻法律解释和法律翻译之间的同异，探讨法律解释原则对于法律翻译的启迪。法律翻译是译者的消化和重建历程，它通过对法律文本的理解和掌握，在充分发挥译者能动性的前提下，对翻译主体的法律意蕴进行语言间的转换。虽然法律解释常在法律领域被探讨，而法律翻译多由语言领域所垂青，但二者在文本理解方面都强调理解法律的历程。法律解释和法律翻译，前者是单语间的作用转换，后者是双语或者多语的表达历程。前者的实现更多是由法官来完成，而后者多是译者和其他涉及双语及多语的法律人完成。上世纪七十年代以来，对于法律解释的探讨使得法律解释的精髓扩大到其他交叉领域，我国对于法律解释和法律翻译的比较探讨也方兴未艾。本论文首先对法律解释和法律翻译近况做出简单描述，比较两者同异之处，而后详细浅析平意原则和理解原则，在深刻剖析法律解释规则进展的同时，对法律翻译近况进行浅析，亦比较浅析法律解释规则和法律翻译两者间的关联，进而寻找法律翻译论述拓展的视角，力图在突破语言翻译论述禁锢的同时，期希回归法律翻译的正确论述导向和在合理基础上的法律翻译对策。关键词：法律解释论文法律翻译论文理解原则论文平意原则论文对等翻译论文
